they keep raiding the cities instead of keeping them!!

i dont know what the deal is but i have the new patch installed and for some reason instead of letting me take over the city like i always have before they raid it without even asking me which i want and then i have to move a settler there to build so how come now i dont have a choice???

Post-patch cities are automatically razed, unless they are more than size one or have generated culture points (i.e. have expanded).
