What sort of ninny shoots an unarmed man without so much as a warning?

I have to admit that if I was to find a burglar in my house there's every chance I might batter him in blind panic.

You can't use deadly force, unless you are threatened with deadly force yourself. So, while you could shoot someone who carjacked you or broke in, if you have a reasonable suspicion that they will try to kill you, you cannot shoot a guy who is, for example, running away when he sees you have a gun.
HOWEVER, if you shoot someone that has broken into your house just because he is creeping around your house (and you don't say "I got a gun"), then you are guilty of at the very least manslaughter, but depending on what jurisdiction, probably murder

I believe alot of white people feel this way. I don't believe the average black guy who is likely to go to prison feels this way. He doesn't fear rape because he is in the majority and likely is already in a gang before he went to prison. If that statement makes me racist in your view, that's life.
I believe I'm not a racist however, but a realist.

That's why you don't want to go to jail?
I don't want to go to jail because I like living in my apartment, going out to eat, going to clubs, hearing groups play, going to the park, going to school and generally hanging out with my friends.
If you're right, then it's good we have black prision gangs or there'd be more crime out there.
P.S. Would you mind being raped by a white gang?

In Lousiana (for example) I can defend myself by shooting you if I suspect that you are about the car jack me. That recent law has cut down on the number of car-jackings substantially.
If I miss you with a twelve gauge and you're running away I wont shoot again.

If you are going to shoot people who commit crimes against you make sure you have a second weapon that isn't registared in your name to place on the criminal. Oh, and make sure your prints aren't on it.
I personally think that laws that prevent us from shooting people who break into our homes are bullshit. Breaking in peoples houses is not cool.

Even the South is changing. They are more and more following the Model Penal Code. You won't be able to escape liability for premeditated murder for much longer, I assume.

Like, if a guy runs towards your car and is black, the police would probably consider that as a rational suspicion, or can you just shoot at anyone you like and tell the police you suspected he was a carjacker to get off any charges?

I'm sorry to hear that Che.. That kind of stuff can make people paranoid. The chances are that this was not the first time these guys did something like this, and chances are they will do it again, to someone else. But there is some comfort in it too, probably they will get caught some day, and they surely are not having any personal hard feelings for you. That means you're pretty safe, or as safe as you were before the attack. I hope you're ok mentally though, maybe you got traumatized, but you will be ok, time makes it better.
I don't know about the area or dangers you have to deal with or the trend about kids having guns where you live.
I'd get a gun, but I wouldn't carry it with me, just for home. However there has been some mistakes before, since this happened to you. You were caught by surprise and that makes your ability to defend yourself a lot weaker. Of course you can't assume that every kid is going to attack you.. I think it's important to know how to react in these kind of situations, and train and educate yourself against these kinds of situations. You have to make sure you're not caught by surprise, so you can defend yourself intelligently. Positioning yourself right way, being able to control your fear and adrenaline and use it against the attackers or escape, not against yourself by freezing up. It happens a lot, freezing up and not being able to think fast. In this situation escaping was the only good thing to do, so kudos to you.
If you are fairly physical and able to defend without weapons, don't be afraid to hit attacker. Just hit them hard and many times, even when they're already in the ground. Make sure they won't get up and pull a gun on you when you turn your back. And when you think they've had enough, hit them little more and call the cops. Be mean and nasty. Bite if you have to. If it gets life threatening, push your fingers through the attackers eyes hard, it should work. Kick to the balls. JUst don't do the mistake of not defending strong enough and giving the attacker a chance to counter.
You'll be ok, I'm sure.

And Bernie Getz should have landed up in jail. As soon as the potential muggers were no longer a direct threat to him he had the responsibility to stop firing.
As for me, I'm glad I don't have to ride the metro in a district where Bernie's cousin would get off.

Frogger: that situation is a bit different. Those people admitted that they tried to rob him. I don't think he should've shot them without warning, but if he would warn them to freeze, why shouldn't he be able to stop them? He could call the police, and arrest them.

the fact they were trying to mug him, and he drew a gun is a pretty good sign. they should've raised their arms and stopped.

One thing I want to know; and it's related more to the other thread about your new gig than this one where you got kicked to the curb .
Now that you'll have bucks coming in, can I pick out your new boots?
Lord knows the only taste you've shown so far is with your wife.
So how about it? Personal shopper for the day?

I'm afraid of very little. I know how to fight with and without weapons. If you want to win (and live) you hit first and hard and you dont stop. Your naivte is that you dont know that.
