if youre convicted you're a convict.
if you commited a crime youre a criminal.
EG "i dont go to the that neighborhood cause of all the criminals" does not imply that all the criminals have been arrested and convicted.
If its not a crime youre not a criminal.
If the law is never enforced, eg pot laws in some places, arguably the action is not a crime.
This would seem to apply whether the "crime" is victimless (pot) or has a victim (theft of intellectual property)
It is certainly not the case that everyone has downloaded music or software in violation of intellectual property laws - i have not.
